General Terms and Conditions of Sale
GENERAL PROVISIONS

These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) govern the purchase of services provided by RR Solutions KG des Rudolf Rienzner & Co. (the “Services”) through the website www.famulus.app (hereinafter the “Website”).

The Customer acknowledges that:

- this is the official Website of RR Solutions KG des Rudolf Rienzner & Co., with registered office at 39100 Bolzano (BZ), Brennerstraße 9/A, Italy, Tax ID No. 02647460217 / VAT No. IT 02647460217, Companies Register of Bolzano No. 0194088, R.E.A. No. BZ-194088;

- the seller of the Services, and contracting party under these Terms and Conditions, is RR Solutions KG des Rudolf Rienzner & Co., with registered office at 39100 Bolzano (BZ), Brennerstraße 9/A, Italy, Tax ID No. 02647460217 / VAT No. IT 02647460217, Companies Register of Bolzano No. 0194088, R.E.A. No. BZ-194088, e-mail: info@famulus.app, tel.: +39 0471 181 7746 (hereinafter the “Seller”);

- orders may only be placed by individuals of legal age and with full legal capacity. Where an order is placed on behalf of an association or a company, the individual must be duly authorized to bind such association or company;

- the contract language is German. In the event of discrepancies between versions of the Terms and Conditions in a language other than German and accepted by the Customer, the German version shall prevail for interpretation purposes.

ARTICLE  1 – Subject Matter and Conclusion of Contract

Through these Terms and Conditions, the Seller sells to the Customer, who places an order via the Website, the Services offered for sale on www.famulus.app.
The contract is concluded exclusively online by the Customer accessing the Website, submitting an order in accordance with the procedure provided on the Website, and the Seller accepting such order. The purchase is governed by these Terms and Conditions, which must be accepted in full and without reservation by the Customer. To this end, the Customer undertakes to read these Terms and Conditions and the pre-contractual information provided on the Website before completing the purchase.
An order submitted via the Website constitutes an offer to purchase, binding only on the Customer. The Seller reserves the right not to accept orders in the event of unavailability of hardware at the requested date. In such cases, the Seller will inform the Customer of the non-acceptance. In all other cases, the contract of sale is concluded upon confirmation of the order by the Seller. The Customer will receive an order confirmation by e-mail, which will include the Customer’s details, order number, price, and the date on which the Famulus hardware will be provided. The Customer undertakes to verify the correctness of such data and promptly notify the Seller of any corrections.
The confirmation e-mail will also include a PDF copy of these Terms and Conditions and a PDF quick installation guide for the Famulus system.

ARTICLE  2 – Pre-Contractual Information

Before concluding the contract, the Customer is informed on the Website of the characteristics and operation of Famulus. Prior to placing an order, the Customer is specifically provided with the following information:Vor Vertragsabschluss wird der Kunde über die Eigenschaften und das Funktionieren von Famulus informiert, was auf der Webseite erklärt wird. 1. the identity of the Seller;
2. the total price of the Services including applicable taxes;
3. the method of payment;
4. the terms, time limits, and conditions for exercising the right of withdrawal;
5. the applicable terms of customer support.

ARTICLE  3 – Terms of Payment

The Seller accepts payment by credit card or bank transfer. The Seller is not liable for failed or unauthorized payments.
Unless payment has already been made during the order process, the Customer undertakes to pay upon receipt of the invoice and in any event no later than 14 days after receipt of the invoice. Otherwise, late payment charges may apply. Payment details will be provided in the order confirmation e-mail.

ARTICLE  4 – Right of Withdrawal

The Customer may withdraw from the purchase at any time, provided that the 10% cancellation insurance was selected at the time of order. In all other cases, 100% of the costs will be charged in the event of withdrawal.

ARTICLE  5 – Installation and Customer Support

The Famulus software operates in conjunction with technical devices such as Epson receipt printers, routers, and Android phones. Proper operation requires strict adherence to the installation instructions.
The Customer will receive a free initial training session. Existing Customers may select further training as an option (subject to an additional charge) in the order form.
The Customer will also receive the hardware and required software several days prior to the agreed and confirmed date, to allow testing in advance.
On the agreed date, no Seller technician will be present on site; however, telephone support is available.
Customer support is available free of charge during business hours on weekdays (Mon–Fri, 09:00–12:00 and 14:00–17:00).

ARTICLE 6 – Liability

The Seller guarantees proper functioning of the Famulus system provided that it has been correctly installed.
The Seller is not liable for the functioning of the Famulus system if the Customer fails to follow the installation instructions (e.g., placing the router in a closed container without reception) or if the hardware is misused.
The Seller is not liable for deficiencies due to force majeure or unforeseeable circumstances, including disruptions or failures of devices, internet, or local WLAN.The Seller accepts no liability for damages, data loss, or economic losses. The Customer purchases and uses the Services at their own risk.

ARTICLE 7 – Customer Obligations

The Customer undertakes to promptly notify the Seller of service failures or problems. Unauthorized access by third parties is prohibited.

The Customer authorizes the Seller to use their name in connection with the Services provided as a reference in oral and written form, and grants the Seller a free license to use the Customer’s name, logo, and photos or videos of the event where Famulus was used, on the Website and social media.

ARTICLE  8 – Final Provisions

The Famulus system is sold with the features described on the Website and under the Terms and Conditions published on the Website at the time of the order, to the exclusion of all other terms and conditions.
The Seller reserves the right to amend these Terms and Conditions at any time at its sole discretion, without prior notice to users of the Website. Any amendments shall become effective as of the date of their publication on the Website and shall apply only to sales concluded thereafter.
The prices, Services offered for sale on the Website, and their features may be changed without notice. Before submitting the order, the Customer will be requested to verify the final sale price.
These Terms and Conditions consist of the entirety of the clauses herein. Should one or more provisions be invalid or declared invalid by law, regulation, or decision of a competent court, the remaining provisions shall remain fully valid and enforceable.

ARTICLE 9 – Governing Law and Jurisdiction

These Terms and Conditions are governed by Italian law. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the Court of Bolzano, Italy.
